本利用規約（以下「本規約」といいます）は、Masanori Uesugi（以下「当社」といいます）が提供するモバイルアプリケーション「Capty」（以下「本アプリ」といいます）の利用条件を定めるものです。本アプリをダウンロードまたはご利用いただくことにより、本規約に同意したものとみなされます。

1. 契約当事者と適用範囲

本規約は、利用者と当社（Masanori Uesugi）との間の契約であり、Apple Inc.（以下「Apple」といいます）は本契約の当事者ではありません。Appleは、本アプリおよびそのコンテンツに関していかなる義務・責任も負いません。

2. サービスの概要

本アプリは、カメラで美術作品をスキャンし、AI技術を活用してアーティストや作品に関する解説ストーリーを生成するサービスです。

3. ライセンスの付与

当社は、利用者に対し、利用者が所有または管理するApple製デバイス上で本アプリを使用するための、非独占的かつ譲渡不能なライセンスを付与します。本ライセンスは、App Store利用規約に定める使用ルール（ファミリー共有を通じたライセンス共有を含みます）に従うものとします。

4. 知的財産権

本アプリおよびそのコンテンツに関する知的財産権は、当社または正当な権利者に帰属します。無断複製、改変、リバースエンジニアリング等は禁止されています。

第三者が本アプリに関する知的財産権の侵害を申し立てた場合、当該申立てに対する調査、防御、解決および免責の全責任は当社が負うものとし、Appleはその責任を負いません。

5. AI生成コンテンツ

  • AI生成コンテンツの正確性・完全性を保証するものではありません。
  • 教育的・参考的な目的での利用を想定しています。
  • 当社の公式見解を示すものではありません。

6. サブスクリプション

  • 有料プランはプラットフォーム提供のサブスクリプション方式です。
  • キャンセルされない限り自動更新されます。
  • 課金や返金は各プラットフォーム規約に準拠します。

7. メンテナンスとサポート

本アプリの保守およびサポートに関する一切の責任は当社が負います。お問い合わせは submappou@gmail.com までご連絡ください。

Appleは、本アプリに関するメンテナンスおよびサポートサービスを提供する義務を一切負いません。

8. 保証

本アプリは現状有姿で提供されます。当社は、正確性・完全性・特定目的への適合性等を保証しません。通信環境や第三者サービス障害等に起因する不利益についても責任を負いません。

本アプリが適用される保証に適合しない場合、利用者はAppleに通知することができ、Appleは該当する購入代金を返金する場合があります。適用法令が許容する最大限の範囲において、Appleは本アプリに関するその他の保証義務を一切負いません。保証不適合に起因するその他の請求、損失、責任、損害、費用については、当社が責任を負うものとします。

9. 製造物責任

本アプリまたは利用者による本アプリの所持・使用に関連して生じるすべての請求（製造物責任に基づく請求、適用法令・規制への不適合に関する請求、消費者保護法またはこれに類する法令に基づく請求を含みますが、これらに限られません）については、Appleではなく当社が責任を負うものとします。

10. 法令遵守

利用者は、以下を表明し保証するものとします。

  • 米国政府による禁輸措置の対象となっている国、または米国政府により「テロ支援国家」に指定されている国に所在していないこと。
  • 米国政府の禁止または制限対象者リストに掲載されていないこと。

11. 第三者の利用規約

利用者は、本アプリの使用にあたり、適用される第三者の利用規約を遵守しなければなりません。例えば、本アプリの使用が利用者の無線データサービス契約その他の第三者との契約に違反してはなりません。

12. 第三者受益者

利用者および当社は、Apple Inc. およびその子会社が本規約の第三者受益者であることを認めるものとします。利用者が本規約に同意した時点で、Appleは本規約を第三者受益者として利用者に対し執行する権利を有する（かつ、当該権利を受諾したものとみなされる）ものとします。

13. 規約の変更

当社は必要に応じて本規約を更新します。更新後に本アプリを利用した場合、変更後規約に同意したものとみなします。

These Terms of Service ("Terms") define the conditions for using the Capty mobile application ("App") provided by Masanori Uesugi ("we", "our", or "us"). By downloading or using the App, you are deemed to have agreed to these Terms.

1. Agreement Parties and Scope

These Terms constitute an agreement between you and Masanori Uesugi only, and not with Apple Inc. ("Apple"). Apple has no obligation or liability whatsoever with respect to the App or its content.

2. Service Overview

The App scans artworks with a camera and uses AI technology to generate explanatory stories about artists and artworks.

3. License Grant

We grant you a non-exclusive, non-transferable license to use the App on any Apple-branded device that you own or control. This license is subject to the Usage Rules set forth in the App Store Terms of Service, including any license sharing permitted through Family Sharing.

4. Intellectual Property Rights

All intellectual property rights related to the App and its content belong to us or legitimate rights holders. Unauthorized reproduction, modification, reverse engineering, source-code extraction, or derivative creation is prohibited.

In the event of any third-party claim that the App or your possession and use of the App infringes a third party's intellectual property rights, we, not Apple, shall be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

5. AI-Generated Content

  • AI-generated content is not guaranteed to be accurate or complete.
  • The generated content is intended for educational and reference purposes.
  • Interpretations and evaluations generated by AI do not represent our official opinions.

6. Subscription

  • Paid plans are provided through subscription systems offered by the platform (such as the App Store).
  • Subscriptions automatically renew unless canceled.
  • Billing and refunds are governed by each platform's policies and terms.

7. Maintenance and Support

We are solely responsible for providing any maintenance and support services with respect to the App. For inquiries, please contact us at submappou@gmail.com.

Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

8. Warranty

The App is provided on an "as is" basis. We do not provide any express or implied warranties regarding accuracy, completeness, reliability, or fitness for a particular purpose. We are not responsible for disadvantages caused by communication environments, device conditions, or failures of third-party services.

In the event that the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty shall be our sole responsibility.

9. Product Liability

We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

10. Legal Compliance

You represent and warrant that:

  • You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country.
  • You are not listed on any U.S. Government list of prohibited or restricted parties.

11. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the App. For example, your use of the App must not violate your wireless data service agreement or any other third-party agreements.

12. Third-Party Beneficiary

You and we acknowledge and agree that Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple shall have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

13. Changes to Terms

We may update these Terms when necessary. If you continue to use the App after changes are made, you are deemed to have agreed to the revised Terms.
